Direclynx Inc
will make a "best efforts" attempt to ensure that the provided services
are available at all times. This will include maintaining backup power
on site in the form of uninterruptible power supplies. Regular tape backup
will be made by Direclynx Inc. and reasonable effort will be made by Direclynx
to restore any material lost due to equipment failure, or loss of backup
by the person responsible for administration of any website. However, Direclynx
Inc is not liable for any material lost or corrupted on any domain hosted
by Direclynx. The customer is responsible for maintaining backups or archives
of data on the customer’s web site. Backup service is not part of this
contract, and Direclynx Inc is not responsible for the loss of any data
which the customer has failed to back up
Direclynx Inc
assumes no liability for network. Lost business or any other form of damages
will not be permitted under this contract.
The user agrees
that the use of Direclynx Inc hosting services will not be to further any
illegal activity, such as the unauthorized distribution of copyrighted
or obscene materials. Slander/libel of businesses or individuals is likewise
prohibited. The distribution of pornographic materials is prohibited, even
if the materials are not obscene according to legal standards. The distribution
of racist or violent materials is prohibited, including such materials
as information related to making explosives or information tending to promote
racism or intolerance of religious beliefs.
Any material
placed on Direclynx Inc's network which is causing substantial network
performance issues for other customers may be removed without notice. The
distribution of "Spam" (unsolicited e-mail, as the term is commonly used
in the internet business) is prohibited.
Determinations
regarding whether materials constitute prohibited activity by the customer
will be made at the sole discretion of Direclynx Inc. Permitted remedies
may include, but are not limited to, removing the offending materials or
terminating the account without prior notice.
We do not impose
data transfer limits on our webhosting accounts, but any website which
is drawing an amount of traffic sufficient to endanger service to other
users may be shut down to preserve service to our existing customers. This
decision will be made at the discretion of Direclynx Inc staff.
Technical support
relating to this service will be provided only relating to the hosting
service itself. Direclynx Inc will not provide technical support relating
to implementation of features or web site design. If the hosting service
is capable of providing the services that Direclynx Inc represents that
the service can provide, then the issue is not covered under the Direclynx
Inc technical support policy.
This agreement
is complete as written. No oral or unattached, un-initialed, written representations
are part of this contract.
The laws of the
State of Arkansas apply when interpreting this contract. Any dispute arising
from this contract may be raised originally only in the Circuit Court of
Garland County.
The implied or
express waiver of any part of this contract by Direclynx Inc does not prevent
Direclynx Inc from enforcing the contract, including any portion subject
to the waiver.
